    1.  Duration of Contest

    This contest will take place on the Internet at a time yet to be determined.

    2.  Eligibility

    2.1

    This contest is open to all Canadian internet surfers who are Canadian residents and under the age of 18. This excludes all employees, representatives and agents of the "TOMA Foundation for Burned Children", "Add Value International", its advertising/promotion agencies, and all its goods and services suppliers related by near or far to this promotion. Any person who lives with the fore-mentioned employees, representatives or agents are also excluded.

     

    2.2

    For purposes of this contest, the contestant will be deemed to be the individual whose name appears on the contest ballot entry form, found on the "TOMA Foundation for Burned Children" internet website. Proof of age may be required.  

    3.  How to Enter

    3.1

    To take part in the "Name the TOMA Mascot" contest, one must:
    • Fill in their name, address, telephone number and email address on the electronic entry ballot, available at the following internet address:
      http://www.fondtomafound.org/english/kids/contestform.htm
    • At the appropriate place on the electronic form, enter the suggested name for the TOMA Mascot. Then click on the SUBMIT button to automatically be registered for the contest.
     

    3.2

    The number of entries is limited to one contest registration per person, per email address and per residence for the total length of the contest.

     

    3.3

    No purchase is necessary. All entries must be received no later than XXXXX. A confirming registration email will automatically be sent to each contestant.
     

    4.  Prizes to be Won

    PRIZES TO BE WON WILL BE LISTED HERE SHORTLY.

    5.  Winning Entries

    5.1

    The winning name that will be retained as the TOMA Mascot’s official name will be determined from the total of all entries received and based on the most votes for each submission as of the end of the contest on December 31, 2006. Any visitor, younger than 18 years old who visits the TOMA web site may enter the contest and submit a ballot and may also vote for his or her choice of names for the TOMA Mascot. One submission only and one vote only per email address. All the proposed names from all entries received will be posted on the site and only those entries sent in on the specially provided electronic entry form shall be accepted.

     

    5.2

    The contest organizers will contact eligible entrants by email. The number of votes received for each entry will decide the winner. The winning candidates will then be informed as to how they can have their prize delivered to them.

     

    5.3

    If, after having taken reasonable measures, the contest organizers are unable to contact a winner within seven days after the close of the contest, that individual shall be disqualified and the organizers shall declare the second place winner as first prize winner. The chances of winning are based solely on the number of registered visitors to the web site and to the number of votes cast by participating visitors for each published entry.

     

    5.4

    The refusal to accept a prize shall discharge the TOMA Foundation for Burned Children and its associates of all and any obligation.

     

    6.  Exoneration

    6.1

    Prior to being declared a winner, the parents, tutors or guardians of a selected participant will have to sign a document attesting to the eligibility of the winner as described in paragraph 2 of the present rules and a declaration of conformity to the contest rules or declaration of exoneration releasing the "TOMA Foundation for Burned Children", its advertising or promotional agency, the prize sponsors and their staff as well as the whole of the administrators, directors, managers, owners, associates, and employees of any responsibility causing damage/loss from entering or taking part in this contest, or a loss resulting from attributing, accepting or using of the prize.

     

    6.2

    The parents, tutors or guardians of the winning children, by accepting the prize, hereby agree and consent to the use and media diffusion of the names, place of residence, voice, image and/or picture or other representation of the winning child, declarations as to the prizes and that these may be used for publicity purposes, the whole without renumeration. Furthermore, the parents, tutors or guardians confer entirely and exclusively to the "TOMA Foundation for Burned Children" all physical and intellectual propriatary rights of the name suggested by the participating child and all electronic ballots for this contest become the exclusive property of the "TOMA Foundation for Burned Children."

    7.  Other Clauses

    7.1

    All ballot entries are subject to verification by the contest organizers. Entries that are incomplete, fraudulent or do not conform to the present contest rules shall automatically be rejected and will not allow for any prize. In such an instance the organizers shall proceed to a new selection.

     

    7.2

    Prizes must be accepted as awarded and may not be transferred, substituted or exchanged, in part or in whole for cash. In the event that, for reasons out of their control and not related to the winners, the organizers could not attribute a prize as stated in the present rules, they reserve the right to substitute a prize of the same nature and of equivalent monetary value.

     

    7.3

    The contest organizers will not accept any responsibility stemming from any malfunction or failure of electronic apparatus or equipment, software or hardware, transmission or communication media relative to the loss or absence of network communications resulting in faulty, incomplete, unreadable or erased ballot from any computer or network that might in any way limit or prevent the possibility of any individual’s participation to the contest.

     

    7.4

    >The TOMA Foundation for Burned Children as well as any of its affiliated agents or agencies will not assume any responsibility of any nature in any event of a strike, lockout or any other work conflict in the establishments or organizations or enterprises of which services are used for the purposes of this contest.

     

    7.5

    Participation to this contest implies, and brings with it, the accepting of the present contest rules of which the TOMA Foundation for Burned Children shall be solely responsible for enforcing. All decisions shall be final and without appeal.

     

    7.6

    This contest is subject to all federal, provincial and municipal laws.

     

    8.  Sundry

    8.1

    The contest organizers reserve the right, at their sole discretion, to cancel, suspend or terminate the present contest in the event that a computer bug or virus, unauthorized human intervention or any other cause out of their control may corrupt or affect the administration, security, impartiality or normal flow of the contest.
